But what are these tests?

Firstly, according to the Humane Society International, all procedures that are carried out on live animals are called tests. In other words, it doesn't matter whether to research and evaluate the effectiveness and safety of new products. By the way, it can be in any area: cosmetics, medicines, cleaning products, among others.

How did it start?

PETA – People for the Ethical Treatment of Animals – a non-governmental organization founded in 1980, has been fighting for three decades to ban the use of animals for testing cosmetic products. Here in Brazil, the NGO PEA – Projeto Esperança Animal is taking on this fight, including certifying brands that do not test on animals in various sectors.

Advances in legislation on the subject in Brazil:

In Brazil since 2008 with Law No. 11,794 of 10/8/2008, the use of animals in teaching and scientific research activities is regulated by the National Council for the Control of Animal Experimentation – CONCEA created within the same law.

However, there is no federal law that prohibits testing, but due to pressure from civil society together with NGOs, mainly PEA, eight states no longer allow cosmetics to be tested on pets.

States that already have laws prohibiting brands that test on animals

Basically, it was São Paulo that first took the initiative with bill 777/2013. The project was then approved as a law in 2014, prohibiting experiments and testing on animals, cosmetic products, personal hygiene products, perfumes, and their components throughout the state.

The State of Mato Grosso do Sul sanctioned Law 4,538/14 which, in addition to the ban on animals being tested in the cosmetic industry, also allows the Public Power to reverse the values ​​of the fines applied (art. 05, items I, II and III) to cover :

“actions, publications and public awareness about responsible ownership and animal rights”;

“animal institutions, shelters or sanctuaries;” or

“state population control programs through surgical sterilization of animals and other programs aimed at the protection and well-being of animals.”

Then, other states also passed laws that prohibited companies from testing on animals.

Amazonas – Law 289/2015, Paraná – Law 18,668/2015, Pará – Law No. 8361/2016, Rio de Janeiro – law 7,814/17, Minas Gerais – Law 23,050/18 and, Pernambuco – LAW No. 16,498/2018
